just to update on this the promised update at end of August did not take place, I did a credit report today and the items are still there, so will call them again tomorrow, same person, and see if they have an explanation.
Its just another example of promising something then not doing it by this bank, and if I don't get satisfaction on the call will have to escalate it in some way.
Will report back after tomorrow.
Just another update on this from Experian today :
Thank you for your email, which we received on 29/08/2014.
*Bank of Scotland Accounts
Looking through our records it appears that the accounts are all marked as settled. In regards to the settlement date the lender has confirmed that the settlement date is correct.
The accounts are marked as settled around November 2008 and therefore will be removed until six years from the date of the settlement.
If you wish to discuss this further with the lender concerned I suggest you contact them directly.
----------
So the bank telling me one thing with the persons name and number noted, then someone else at the bank tells the credit reference company the total opposite.
The biggest issue of all being no one definitive department or person can be contacted at the bank to resolve this, and to compound it the credit reference agency just bat it away saying, you have to contact the bank to sort it, and the circle goes on.
But I will be on the phone to them again tomorrow, undeterred 🙂
and from Equifax, very similar standard response third time I had this seemingly in a loop like Experian, I have long threads of questions on the same subject, I tell them that when raising the dispute but you still get standard responses.

Thank you for getting in touch.

Hi OutofDeed/TDA
I wrote to Noddle and Experian. Noddle has replied as follows:
-------------------------
Thanks for your email. An account in default will be reported as in default until the full amount has been paid in full and default will be removed 6 years from the date of default even if it wasn't paid in full on that date. For example your Max Recovery account will drop off your report 03/09/2015 and your Trust Deed will be removed 05/08/2015.
So I can confirm having looked though your credit report that all your accounts that were in default and are now marked as satisfied will be removed in 2015 as the date of default on then all is 2009.
I hope I have managed to explain this for you but please let me know if you have any further questions
--------------------------
(I realised the Max Recovery account date was after 05 August, however, it was close enough for me not to go through long hassle of getting it changed to a month earlier).
I realised what you mean about the monthly defaulted record OutofDeed. Could it be that it was not the monthly default status that affected the decision about your credit? A friend of mine obtained credit almost immediately after her Trust Deed was cleared.
From some of the posts here, decisions are often random regarding credit. Just a thought.
It will be interesting to hear the response TDA gets from the ICO.
I got through to the bank again and got a different girl.
After around an hour explaining everything again and being on hold I got the supervisor.
I insisted he call CRA while I waited on the phone, and he confirmed although they promised the action of updating the file to show settle date of 19-05-08 they had not done it and didn't know why.
He then went on to say that they had now made an emergency entry through the system and that next time I run a credit report at the end of the week all this should be cleared off as over 6 year old.
To my pleasant surprise he said in light of the fact this was my 9th call on the same topic, and I am clearly correct in pointing out they have made an error, he is sending me a cheque for GBP 100 as apology, GBP 60 for cost of phone calls ( even though its a free number ! ) 20 for the inconvenience and 20 as an apology.
I must confess that I did not expect 🙂
Well done OutofDeed!
You're the second person in a week outofdeed that I know who has had a payment of £100 from a bank for the problems they have caused the individual.
The persistence paid off for you. Well done.
