Das nightmare

Hi again, can I pick someone's brain. I've been in a das scheme for few months now, have had lots of letters from my creditors saying they have sold my debt to debt collection agencies and the like. Contacted my das administrator who told me its nothing to worry about.
I arrive home to a nasty call tonight from santander telling me that because I am I arrears although I have a das and they are being paid and have been getting paid throughout that they are billing me a late payment fee and interest per month of almost ยฃ100 from now on starting this month. Have explained my das and told them they cannot add more interest on as it has been enforced but they are taking no notice.
Any advice please should I contact my administrator again & explain this further saga?

I thought once my das was up and running I would not incur any further interest and charges, is this not correct?

I'm not sure who you mean when you talk about "your" DAS Administrator.

Is it your money adviser? Your payments distributor? 'The' DAS Administrator, in Kilwinning? They're all different, and they can all do different things - so it's important to know which one you have been talking to.

Either way, they're right to say that this nonsense from your creditors is nothing to worry about. The interest and fees are frozen. They're not being added into your DAS. You only have to pay back the amount that was agreed at the beginning.

As long as you finish the DAS as agreed, the creditors can't chase you for any further interest or charges.

However, it's is obviously worrying you, so tell your money adviser or the DAS Administrator about it. They can write to these creditors to tell them to back off. They also need to know if the debt gets sold on, so that they can make sure the money goes to the right place.

So, I'd say that it's probably worth calling them.

Thankyou sorry I meant I was talking to my insolvency company I am with who arranged my das for me. I will call them tomorrow to hopefully get this resolved.

It's an interesting point. I met with someone a few weeks back who was 2 years into a DAS and still received threatening letters. Not a problem as they can't actually do anything, but I wonder if creditors are generally unsure of the DAS process and chance their arm.

Sequestration & Trust Deeds appear to be the opposite where letters/hassle etc die down ( with the odd exception) to nil

I think you're right about creditors not knowing about DAS, Mark.

Look how long sequestration and trust deeds have been around - compared to DAS.

Plus the fact that English creditors can relate 'sequestration' to 'bankruptcy'. They can relate 'trust deed' to 'IVA'.

Ok, they're not exact parallels, but it gives creditors the gist of it.

DAS? There's no English equivalent. I'm sure most of the creditors think that it's just a debt management plan, and that they can opt outof it when they feel like it.

And, let's be honest, I'm quite sure that some of the creditors - English, Scottish and others - are just chancing their arm!

As much as Santander might like to, they cannot rewrite the law no matter what they say!

I'm sure this will all get sorted out. And if it doesn't happen immediately please remember that this is just an annoyance and not a real problem.

I'm glad that this all seems to be sorted Kazibee.

They aren't the only bank that's guilty of this, but you'd think that if Santander are going to deploy an individual to collect debt from residents of Scotland that they might give them at least a basic understanding of how things work.

Hopefully these problems will ease in future given that the Debt Arrangement Scheme is becoming more popular all of the time.

After my DAS started I took great pleasure in correcting a whole load of callers from the collections departments of various creditors as to what they could and could not do. Don't worry about what they say, the law is clear and they cannot take further action once your DAS has begun.
