CSA Arrears

Have been given conflicting advice. Are CSA Arrears including in a Scottish Trust Deed and is there anyway these can be pursued?

Hello clockwork and welcome to Trust-Deed.co.uk.

I'm guessing from your post that you're owed money via the Child Support Agency and that the individual that owes the money has entered into a protected trust deed?

If that's the case then any arrears will fall into two categories:

1 - Money that became due before the trust deed was signed. This debt will/can be included in the arrangement. You should contact the trustee to make sure they're aware of this debt and that it's included in the case as a claim. You may be asked to provide some proof. At some point in the future this may result in none, some, or all of the amount that was due via the CSA being paid to you. The trustee may be able to give you an estimate of how much will be paid assuming that the arrangement continues as it is expected to.

2 - Money that is due from after the trust deed is signed. You can pursue this in all of the normal ways.

If the arrears accrued before the trust deed was signed they are included. Assuming the trust deed is protected then they cannot be pursued.

Hi clockwork

We have a few cases where CSA are creditors and they submit claims like all other creditors, so there should be no issue.
