can anyone tell me if a claim made against me by the csa will be affected by my protected trust deed?

Are you going to find that you have a new monthly expense as a result of the CSA situation?

Do you expect to be able to keep up your trust deed payments?

its looking like i will be paying about ยฃ50 per week in maintenance to my ex just found out today he has put a claim in against me and wondered if the csa will take my trust deed into account? there is no way i will be able to pay both

Hi shelley71.

My understanding is that your trust deed will not be taken into account I'm afraid.

You may wish to contact your trust deed firm and discuss what the options will be if this works out as you expect.

No, ongoing payments would need to be paid to csa, although if any of this related to arrears then that element would be a claim in the trust deed but only up to the date the trustee was appointed.

hi can the csa now make a claim even though I am 18 months into a TD,
I cant afford their request

Welcome to the forum allastairs.

I'm afraid the CSA will probably not take the trust deed into account.

They have a formula for payment that they use based upon your income.

This may affect your ability to maintain your current protected trust deed payment, in which case you'll need to discuss the options with your trustee.

Are they looking for repayment of any arrears allastairs? If so then that part would be included in your trust deed if it was from before the date you signed the trust deed.
