Creditors still chasing us

[:(] We're a few months and 2 payments into our PTD and at the beginning got loads of texts/voicemails/letters from most of creditors but once we informed them we were protected, they seemed to tail off. However, we got a text followed by a telephone call on Sunday morning from one of our creditors (Barclays Partner Finance)who were trying to get my OH to make a payment. He told the lady repeatedly that we were in a PTD and to contact our IP (whose details we had already given them weeks ago)- I'm in the background whispering "now hang up, just hang up! She said that they weren't authorised to talk to our IP - KPMG have to contact them which of course they already have.

However, Barclays are insisting that they have not had any correspondence from KPMG and that our accounts aren't on hold and will continue to accrue late charges and interest. This has got us really worried. What happens to all these charges - do they remain or will they be wiped off dating back to the date we signed the TD? They seemed to understand what a TD was but without getting confirmation of signing date etc. our accounts will not be frozen. Should I be sending our loan statements etc to KPMG or just the letters about action etc.?

and it was going so well.....

I do need to phone KPMG but it's quite awkward at work as I'm in a shared office and they only operate Monday to Friday 9-5 [:(!]

Don't pay them anything. If they keep phoning, ignore them but let your trustee know. Send any correspondence to KPMG. If you could even nip out during lunch and phone KPMG then, they should be able to set your mind at ease. I had phone calls and letters for about the first six months of my PTD then they just stopped. You trust deed is protected so your creditors can't do anything now. They'll sell the debt on but just keep in touch with your trustee when you have any contact about it and they'll deal with it. I had Mercers telling me that they'd had no contact but my administrator told me that's a common tactic. Also, sometimes firms based in England will say they don't know what a trust deed is. That's their problem, not yours.

Nothing left to discharge - everything's done and dusted!

Barclays Partner Finance use an agent on their behalf to process their trust deed claims and decisions - Grant Thornton. Your trustee will have written to Grant Thornton I imagine, as Barclays Partner Finance have requested all IPs to do so. If there is a problem it will likely be because Barclays PF have not been made aware by their agent.

Your trustee will need to be made aware of the situation so that they can contact Grant Thornton again, or better still Barclays Partner Finance directly - so I'm afraid you may well have to find some time (maybe lunchtime?) to call them, unless they are available by email?

As others have indicated, Barclays seem to be the most ignorant re PTDs in Scotland - two of their companies were the slowest to recognise my position when my PTD started but they will go away. You being in a PTD is the most important thing and there is nothing in law which they and their agents can do to extract more from you. Remember: they have already agreed to you going into a PTD and it is only their incompetence elsewhere in their mega outfit that has not got the message! Their problem, not yours!

thanks for your replies guys. I'll disappear to another office just now and give them a call. I can't phone on my mobile as we get terrible reception at my work - hanging out windows etc!

Re Barclays being slow - you're right. Every other creditor has disappeared (apart from sending statements) but they just won't go away!

What about the charges etc? Is that their problem, i.e. the more debt they plonk on in the form of charges = the more debt gets written off at the end? Also, will the creditors get regular payments or do they wait until the end of the 3 years and get a lump sum? Just curiousity!

My worst ones were definately Barclays and Cahoot. They referred my account to Mercers and Max Recovery. They were both particularly dense in understanding what it meant to be in a trust deed, even when I told them it was like an IVA. Don't get into discussions with them. They'll try to get payment from you which they aren't entitled to. I understand not wanting to talk to them in an open office, I've had the same problem. I ended up thinking bugger it, I made a mess of things and if my work mates want to think worse of me for that so be it.

Personally, I'd go for the hanging out of windows option. Then no-one would be concentrating on your conversation.[:D]

It took Barclays nearly 4 months to stop contacting me, don't worry just be polite and advise them to contact your Trustee, trust me they will eventually stop.....

You can probably email your IP, I tend to communicate with my company by email as I also work in an open plan office and quite frankly, I don't want anyone knowing my business other than those who need to known! You also have a record of all communication if you deal with them by email. It's RBS I keep getting demands from and I'm 6 months on!

Yeah, they'd be wondering about the unexpected solar eclipse [:D]

I phoned KPMG today (without hanging out the window!) They've given me an email address which is a big help - both in terms of privacy and getting a record of correspondence. Thanks for your reassurances!

Mercers phoned tonight and the clearly automated message was, get this, "We're sorry none of our operators are able to take your call right now but if you would like to speak to someone please call back on .......". Well, if you're unable to "speak to me" right now, why did you bloody phone? Honestly.

Ask for a name, department and location, record it and advise that you have arrangements in place. Clearly, internal communications have not passed appropriate information yet. Rather than waste anyone's time, you need to deal with finances in writing so you have a record. Write it /type it and keep it next to the phone.

Something along the lines of the above is clear and not impolite but allows you to keep some dignity in the process.

I have had some really nasty comments from people sat in call centres, probably one bottle away from a case of Stella reward. You don't need to dance to that tune.

They cant touch you so try to not let them get to you. Inform them you are recording the call as evidence of continued unlawful harassment,point them towards your trustee,and hang up.
