Hi I have received several statements from max recovery who advise that it is a legal requirement to send me these until there are no sums payable and no sums that will become payable. I have not had statements for some time so am confused? Does this mean they will keep these amounts showing long term? I was discharged from my trust seed in 2010. The statement also states that no interest was charged during the statement period but there are payments showing with different dates could this be the payments from my trustee when settling the TD?

Hi magscb14.

This is nothing at all to worry about.

It just seems like Max Recovery are unaware that these debts were covered by a trust deed. If they were it simply doesn't matter what anyone puts on a statement - the money isn't owed.

You could choose to ignore them, or you could choose to contact Max Recovery and require that they update their records.

The payments that you mention could be dividends from your trust deed.

If you were discharged on completion of a Protected Trust Deed then there are no sums payable and they should stop sending you statements that say otherwise.

I would contact them again and insist that they update their records and write off the balance they say is outstanding.

Pretty poor that the customer has to deal with this but just tell max recocery about the TD. No doubt they will want proof etc!!!

Trust deed completed Jan 2012,Trustee discharge Nov 2012.
