Hi All. LITTLE CONFUSED SO ANY ADVICE MUCH APPRECIATERD. fINAL PAYMENT MADE TO td [:D]. td COMPANY SAY THEY ARE HAVING PROBLEMS CONTACTING A CREDITOR (northern rock)THEY SAY THEY HAVE HAD NO CONTACT FROM THEM IN THE 3 YRS OF THE TD DESPITE LETTERS SENT ETC. APPARENTLY THEY WENT BUST OR SOMETHING JUST AFTER ME ENTERING TD. WHAT HAPPENS OF THEY CANNOT CONTACT THEM.? THE TD COMPANY MUTTERED SOMETHING ABOUT FUNDS BEING SPLIT BETWEEN OTHER CREDITORS. SURELY THIS CAN'T BE RIGHT? NR WAS BY FAR MY LARGEST CREDITOR

Welcome to the forum lewpy.

Don't worry about this, it makes no difference to you.

Your trustee will know who to contact about the Northern Rock debt. If they don't respond it's not your problem.

Thanks TDA. Apologies just noted my shouty capitals!is it correct that my payments will be split between other creditors if NR don't respond? if this is the case they will get more than what i owed them in first place. as i said NR was the major one

In sequestration the Trustee can consign the unclaimed funds to the Accountant in Bankruptcy and I would assume the same applies to Trust Deeds. The AIB then hold the funds for 7 years awaititng a valid claim from the creditor before it goes back into the big Scottish economy purse.

Many thanks for your reply. Will this affect my discharge time do you think? Why would the government receive the money i have paid in good faith thinking it was going to pay off my debt(albeit a percentage)?

Hi lewpy.

That's really a question to ask your creditor. If they make their claim they get your money.

There's no real reason for your discharge to be delayed.

Thanks TDA.. Does seem strange tho
So my last payment was end july. my td firm said there would be letters sent out to the creditors. I Have heard nothing since. can anyone tell me what happens now? and what contact i should be expecting from the td firm? i have seen form 5, discharge and trustee discharge talked about on here. Any info on what they mean and what i can expect to happen next and timescales would be appreciated

Form 5 is your discharge. This can happen once you've completed your responsibilities.

Your trustee can seek their discharge afterwards once they've completed their responsibilities.

You could ask your trustee what they expect the timescales to be.

I must admit I find it a bit surprising that NR haven't claimed
- I wonder if the trustee is writing to the correct address?

Hi kevin. I Heard they went bust or government buyout or something? Don't know if this is relevant but acompany trying to claim PPI on it for me says they are coming back with no record of account? i have had to give them some paperwork with acc details etc. strangely the debt is nowhere on my credit report. any insight appreciated

Was the debt a normal loan or was this a 'together' loan obtained with a mortgage?

it was an unsecured loan. did have amortgage with them but that was all cleared off when i separated from husband. Theloan was taken out when we still had the mortgage if that is any help?

It's certainly strange. I've spoken with our department who deal with all our claims and there seems to be no issue getting these. Was the loan joint? Just wonder if your ex may have paid this off.

Bottom line is it will make no difference to your discharge.

Thanks Mark. The TD company asked that question too.... answer defenitely not! I don't know why it is not on my credit report.Thing is if they have written it off somehow i wouldn't have needed TD in the first place
