Hi all,

My bankruptcy was discharged in March this year but as yet none of my creditors have updated my credit files (checked noddle and clearscore) to say the debts have been partially settled or settled and most still have last months date on them. How long does it usually take for that to happen?

Thanks!

Hi Jeangrey

Congratulations on completing your Trust Deed.

The process of updating credit files is not smooth or consistent.

Contact each of the creditors and ask them to (i) ensure default date matches Trust Deed signing date (ii) file is marked as Satisfied or Partially Satisfied. Both in accordance with the Data Protection Act. Provide them with a copy of your Form 5 so they can see the dates.

The Trust Deed and Credit Account defaults will fall off six years after the default date, so those are the important dates.

Although the Data controller should deal with it, in my own experience they did nothing and it is the Account Default department (or similar name) that deals with it. You could start by calling customer services of each one and asking for the number or to be put through. Keep a note of each number, date, time you called and the name of each person you speak to with note of what they say. You may need to use the information if no action is taken.

Good luck!

Good luck with sorting all of this out jeangrey.

I cannot see any reason why the process would be any different whether you've been discharged from bankruptcy or a trust deed.

Another option might be to submit complaints to each of the organisations that are reporting incorrect information to the credit reference agencies.
