Hi there. I received my Form 5 some 4 months ago (personal discharge), however there is a delay in dealing with PPI etc which is preventing my Trustee from discharging themselves. I have a couple of questions I hope you can help me with;

1) Am I now legally debt free?
2) Is there anyway the trustee can ask for more money from myself?

The reason I ask this is that I have been accepted for a credit agreement on a vehicle to replace my 16 year old car, and whilst I am confident I can afford this, I am a little wary of progressing incase the trustee contacts me with a demand for more money.

I have phoned the trustee several times however getting a yes or no answer seems is proving difficult.

Any advice would be appreciated.

Hi sfly

Yes you are debt free and no the Trustee cannot seek more money from you.

The process of discharging you before the Trustee requests their discharge is fairly common, so nothing to worry about.

Congratulations on your discharge, sfly.

As Mark says, you are now debt free (or at least until you get your new car finance!)

Thanks for the reply guys. Makes me wish I looked at this website before choosing a certain large company based in Glasgow!

The car is essential for work so has to be done one way or another.

Good to hear again that said large firm in Glasgow is discharging people while staying on to look into PPI as this is a change from their previous stance. I will be at that point myself in a few months with them so am hoping to be in the same position! Signed a big wad of PPI stuff a few months ago now so hoping they might even be at the end of that too as I'm pretty sure they're chasing nowt!

I am with a large firm in Glasgow, probably the same one altho unsure if able to name it, I have had my ppi reclaimed and offset already(before the end of the trust deed) so will this speed up my discharge, only been waiting since June.

It's certainly one less obstacle to getting your Form 5.
