Charge of payment

Hi,Im looking for some information. I have received a charge of payment for my council tax. The company that sent my charge of payment wants my employers details and won't accept any payment plan until i give my employers details. I am hoping to sign my PTD at the end of january. If i give the company my details will they be able to arrest my wages and if so will the wage arrestment stop when i sign my PTD. Thanks Trish

Welcome to the forum Trish.

It certainly sounds as though a wage arrestment might be the plan for this company.

As I understand it councils do not have to allow council tax debts to be included in a trust deed. I have read Mark writing in the past that some councils may allow it by negotiation however.

It sounds as though things are coming to a head. Is there a reason to delay signing a trust deed until the end of January?

Thanks for replying. The company put the charge for payment through my door 2 weeks ago. I sent them a cheque for ?รบ50 to try and stall them coming back to the door but they won't agree to a agreed amount until i give them my work details which im not wanting to do. I think i will need to sign the PTD in the next week. I was waiting until my next pay at the end of january to sign it. Thanks Trish

Hi Trish

this certainly looks like a plan for a wage arrestment. The Council have powers to fastrack court action and this seems to be what they are doing.

Council Tax debts are included in Trust Deeds, however if there is a wage arrestment in place before the Trust Deed is signed, this will not automatically stop once the Trust Deed is signed.

You might want to think about signing the trust deed asap, Trish, if that is what you wish to do. You shouldn't have to make your first payment until after your next payday anyway. Probably best not give them your employment details as this might increase the likelihood of a wage arrestment, which would throw a spanner in the works.

As Mark says, council tax arrears would always be included in a trust deed, however a wage arrestment is not cut down by a protected trust deed. So if the council had a wage arrestment in place and refused to lift it, then the trust deed would be unworkable and sequestration is likely instead.

I think that's a good move Trish. Sorry for my error in my earlier post, re-reading it I'm really not sure how I came to muddle the two different issues at the time. I'm appreciative to Mark and Kevin for quickly correcting it (which is one of the great advantages of having a number of people answering the questions in this forum).
