Hey there guys, hope all is well,
I'm looking for some advice,

I made my last payment to my trust deed 13 months ago,
this was a lesser amount but this I was informed by the my trustee was what I had to pay, so I did,
Now I heard nothing for a year and today I received a letter from my trust deed saying that it's now time to review my income and expenditure, is this correct a year later from my last payment I'm no wing asked for my income/expenditure, shouldn't I be released from my trust deed 13 months after I made my last payment
Very confused and their office is now closed until Tuesday
Can anyone help ease my worries

Sounds like a computer generated mistake. If you are discharged then bin the letter.

Hi Benjo12.

Have you looked on the (online) Register of Insolvencies to see if you have been discharged yet?

If you haven't, I'd suggest you contact your trustee to establish why not.

Hi Benjo12,

If you have completed all of your payments then I see no reason why you would need to complete another income and expenditure review form. It's probably just been sent out in error.

I would give your Trustee a call and ask them about your discharge which is called a Form 5.

I have checked the online register and I'm still on there no discharge date, yet it's been over a year since I made my final payment, very strange

If that's the case I would be calling them to ask why and to demand your discharge.

Normally we try to discharge someone from their Trust Deed 4-6 weeks after their final payment to their Trust Deed.

Let us know how you get on once you speak to them.

Hi

I just paid my last payment today and on the phone today I was told 6 months to a year before I would get discharged? Everywhere I am reading says it shouldnt take that long?
Any advice would be great.

You should wait no longer than a month to 6 weeks as David has said.

Is this TD firms with-holding discharge in case PPI claims emerge?

Hi karenl1986 and welcome to the forum.

Ideally my firm try to provide a clients discharge within 4-6 weeks of their final payment.

It's a simple process to complete and really shouldn't take much longer than 30 mins to an hour of administration work.

I would speak with your Trustee and demand your discharge within 4-6 weeks. Unfortunately in circumstances like this sometimes the only way to receive your discharge is to keep on at them.

There is a crucial distinction between your own discharge and the trustee's discharge.

Your own discharge should come shortly after you have completed your obligations - ie usually soon after the 4-year period is up or maybe longer if further payments are being made in lieu of equity in a house for example.

Your trustee's discharge would take a bit longer as that can only happen once they have tidied up all loose ends such as distributing the money between the creditors.

I wonder if the 6 months to 1 year that you were quoted is to do with the trustee's discharge? If not then I would certainly be pushing them hard to discharge you a lot sooner than that. I can't see any good reason why it should take remotely as long as that.

Albeit that it was Aug 2012 when I completed my TD, my Trustee was clear that he would not discharge me until he was satisfied I would get no PPI back - despite the ability to release me and keep himself in office. I followed up, wrote, called and asked several times.

It was 13 months later when I faced the possibility of my bank account being closed (due to change in banking terms) that I had to beseech him to discharge me based on the impact it could have. I promised to send him any PPI although I had never had PPI and only one was outstanding. He said that was not enough because I might receive it and keep it.

That was 2012 and things may have changed but the frustration is fresh in my memory.

I am not complaining about how my TD was handled - I never had any problems during it at all and he was fair and reasonable. It was only at the discharge stage which is the time when we all want to see the papers concluded and feel we can move forward at least one step.
