Hi,

I'm looking for some advice regarding Trust deeds etc.

I have debts with i think three companies, the are mostly old debts i had with an ex -partner(they were in joint names and taken out to clear her credit cards/loans etc)after breaking up she went on to declare herself bankrupt which meant i was left with them all.

I tried a Trust deed a couple of years ago but was unable to continue it(i got half through i think) but i was discharged from the Trust deed rather than being made bankrupt, which means i still have all the debt.

I have generally avoided the issue for a while now but i really need to sort it out. I am employed full time but have no assets of any value. I live with my partner and young Daughter but i support us all as my partner doesnt work.

Any advice would be appreciated.

Hi Wednesday

If the Trustee has been discharged, then there is nothing to stop you looking at the Trust Deed as an option, or indeed other options.

I think creditors may have some concern as you did not maintain payments under the last trust deed, but to be honest I don't see this as a real problem.

I am not sure if i would be eligable for the trust deed, I take home before overtime approx £1350 per month yet with rent, council tax and csa payments totalling £950ish per month it doesnt leave me a great ammount left over.

As mentioned in my last email, the Trust deed may be an option as well as DAS, sequestration. If there is little or no surplus income and you have no assets, then sequestration may be an option to look at.

With a limited disposable income, sequestration may be more likely. Everything needs to be discussed so you choose the best option for your situation.
