Hello

Just when i thought this was going to be it KPMG Have now decided they will not be in a position to do anything to the 1st of may?? Thats just under two months now i have to wait again
Yet on this last letter he said he would start his procedure to step down as of march the 1st? Can he do this?? i thought this was it i have done all i can but no matter what they have there claws in and wont let me go.

Mark ive sent you an email could you take a look its in regards to the other thing we previously spoke about.

Hi Reidy

Could you resend it as I've checked and can't see it.

I have no idea how any firm can advise that it will take this length of time, especially given the previous correspondence and continued non action.

At a push, this could be started this afternoon as it would take no more than 20 mins and 14 days later would be finalised. Simple.

Mark not sure if u got the email or not my email account seems to be bouncing back emails now and i dont know why.

Does Anyone have any solutions to what to do now? i'm on the verge of just caving in and just putting up with the struggle every month just to have less grief they obviously have no intention of letting me out since they keep changing there mind all the time, i'm so stressed at the minute.

Hello kevin thank you for responding

His reason was as follows on the letter.

As per section 15 of your trust deed i will take steps to terminate your trust deed when your third consecutive payment is missed. The last date i recieved a payment was january and i will not be in a position to terminate until 1 may 2012 following missed payments.

Accordingly on 1st may 2012 i will write to you both and your creditors confirming that i will proceed to terminate your trust deed. I will also request to obtain approval of my fee's.

On basis no objections are made in relation to my fee's i shall record approval of my fee's and thereafter seek my own discharge as trustee.

I will then write to you both and your creditors on 15th may 2012 enclosing a copy of form 6 in the instance i do not recieve objections by 29th may 2012 from majority of the creditors in value , my discharge will be immediately take effect.

I would like to state though my last payment was not january infact that was the month mark came to see at my home and i stopped paying as of january. So the last payment they got from me was in decemeber and it was only half if you remember i came to trustdeek.co.uk at that point asking for advice because of the changed to payment dates over the holidays and thats how this came to light.
Also when i first started my trust deed when i changed from weekly to monthly payments the women i spoke to said because of the change over i had inadvertly missed one payment allready and could not miss more than another two. (Thats was in september of last year)

So if i missed one in september
Then January (When i stopped)
Then February
Then march (As it would have been due over the weekend) (We now hit the 4th missed payment)

By the time it comes to may it will be 5 consecutive missed payments well over the line. Ive also basically made it clear in my last letter about payments on the advice i was given. Infact i still have copies of them all.
The letter also states if i need anymore communication or questions answered ive to speak to a named person in the office on the above number.

To me it seems he's only holding out long enough to get his fee's. i know that sounds bad for me to say that and he is within his rights but to keep this going after its been clearly stated on various letter back and forth and if that is the case then why in the last two letter did he state he would start proceding as of the 1ST OF MARCH now its changed. It seems to be taking longer and longer maybe i should just give in and get on with it i seem to be stuck between a rock and a hardplace.

It does seem unnecessary to wait until May, though given that you are not making any further payments I don't see how your trustee would get any more towards his fees.

I suspect that he is just being extra careful for fear of potential criticism for terminating your trust deed when you have only missed one or two payments so far according to his calculations.

Hi Kevin thank you for your response.
I just verified on my bank details of the payment i have made to them just to be sure incase i was wrong and calculated it at the 170 i was paying and what should have been paid from the 1st day of paying and i was correct to say as of this month it would now be four consecutive payments as the last payment i made was in decemeber not january and that was only for half. So basically the missed one from septemeber, (Half a payment in decemeber) then a missed payment jan, feb now march.

Hi Reidy1982.

As frustrated as you are, I'd just roll with it for now. It will not make much difference to you in the long-term.

I think Kevin will be right and can understand why the trust deed firm would be cautious in these circumstances.
