After many years and the great progress that has been made in my our personal life I find myself in a precarious position where after moving jobs recently I could potentially have my contract ended due to my trust deed that started in 2011. I am speculating at this stage.

I was discharged from my trust deed and my credit rating is perfect and I knew I would be asked to agree to a credit check etc. the role is working within a FCA regulated environment, same as my previous role however what is potentially going to affect me is that during the on boarding process after receiving the offer of employment when consenting to the check it also asked if you are bankrupt or entered in to an IVA/Trust Deed in the last 5 years so I obviously chooseed no as I my trust deed started in Feb-11 and was discharged Feb-17 however whist completing some documentation on my first day I was asked if I have ever been bankrupt or entered in to a trust deed so have had to choose yes.

After a sleepless night I approached my line manager and explained this and that I was now concerned so they are now looking to set-up a meeting with our HR department and although they had alluded to me being able to provide details that show that I had paid or met the requirements of the trust deed and at the same time provide some back ground information around this they can assess this further.

The contract only refers to being declared bankrupt or entering in to an arrangement and not if it was found you had previously, or prior to being employed by them.

I have searched the forum and there isn’t really anything that gives me any real glimmer of hope and I now dread the worst possible outcome and my head can’t stop thinking that it will come down to what their internal policies on this is.

They commented on my honesty and transparency but this is playing havoc with my nerves at the moment and I have another sleepless night or two ahead and if I am let go I dread to think where this takes me, straight back to the same position no doubt. This could be the end of me this time!!

Very concerned at this stage.

Whilst I obviously can't give you any definitive assurances here, I would be very surprised if your fears become a reality. It is one thing being potentially overlooked when applying for a job due to your credit history, but quite different once you have already started.

It may technically be possible for them to let you go if there is a probationary period stated in your contract for example, but why would they want to do so and go through the hassle of having to recruit again?

I think that sequestration and trust deeds can be more problematic if they are current or start while in a job, but even then such problems are quite rare in my experience. As yours finished well before starting the job and you were up front throughout the recruitment process then I really think you should be fine.

Thanks for your reply Kevin and I am clinging on to that this is the way it is viewed.

Starting a new job is daunting as it is but when trying to impress and and with this hanging around my neck is tough.
