Hi I have completed my last TD payment in December 2012, after continually calling Wilson Andrews for movement on discharge, I got discharged in February this year, Wilson Andrews stated they had one PPI follow up left out of four and the trustee would stay in place until this was completed. They said it would be done by March, I have called them repeatedly and been given 3 different excuses why my trust deed has not been closed yet, it has been with the closing team since July and they said it would be closed by august, then September, then October, I am now at the point were I believe that I am being misled in the reasons why it is still open as they have contradicted their reasons why it is still ongoing. Is there a governing body I can make a complaint to against Wilson Andrews and how I have been treated through the course of this closure period

Shame on them; it is a disgrace that they get away with this. I bet they were quick to get you signed up as soon as.

Some companies do not discharge you until after the PPI is complete - although that may change following a recent advice note issued by the RPB's - so that is a plus point.

In terms of making a complaint, your trustee's rpb is the first point of call and it should be detailed on every piece of corresepondence you have received throughout the term of the Trust Deed. (Insolvency Practitioners Association, Institute of Chartered Accountants Scotland etc)

What problems is it causing you?

I though if you were discharged regardless of your trustee not discharging themselves you would still be in a position to go ahead, write to your creditors have them update your credit files, have the the public notice on your files marked as complete/satisfied etc and them basically get on with your life.

Maybe an expert can clarify, but i am sure if you have a Form 5 your done.

Welcome to the forum monopoly.

If you've been discharged the fact that your trustee hasn't should make no difference to you whatsoever (as pingpong has written). Do you feel that it's holding you back in some specific way?

You do have the right to complain (to your trustee first, then their professional body if you remain unhappy) but hopefully we can show you that there's no need for this if you've been discharged yourself.

I am sorry that we haven't communicated as well as we should in the final stages of your Trust Deed and for the worry this is causing you.

As you know your Trust Deed is, in effect, complete and you have no further contributions to pay. But part of your Trustee's role is to investigate and realise any assets including any (potentially) mis-sold PPI. We do try and push through these investigations as quickly as possible but do often need to chase creditors up for responses.

I do understand it's important for you to be able to move on from your Trust Deed so I would like to look into why there has been a delay and what we can do to get this wrapped up for you.
