WILL IT EVER BE OVER?

I made my last contribution in May last year and then a lump sum in September (borrowed from my parents due to a "misunderstanding" which I would still dispute about an endowment that was to be encashed at the end to pay off the lump sum). Anyway they wrote to me in October to say I'd made all the payments and I would hear from them in due course. I phoned in December and was told statutory matters were still being dealt with. I've just phoned again and been told the same thing that despite the fact that they've had ยฃ25,000 in total by October last year, none of the creditors have yet been paid. They say these things take time they need to wait for responses from creditors etc. etc. sorry I would have thought the creditors would have wanted the monies asap. The girl also mentioned that they could be checking if there was any ppi monies due - I've told them already that there was no ppi. What is going on here, does it really take this long to finalise things or is something else going on that I'm not aware of? I want to try and change my mortgage lender but can't do anything until the discharge comes through so am really getting fed up with it all now.

Hi WIKIKEE.

When did your trust deed start?

It really shouldn't take this long for matters to be brought to an end once you have completed your obligations.

It's one of the things we take an interest in when we are considering inviting trust deed firms to feature on the site because we are aware that it's so important to people to get discharged promptly when they have done what they promised to.

These firms on this site, and to be honest most others, just get once with finalising everything and discharging their client. Some others, I'm afraid, don't seem to care very much.

It was signed March 2008 and became protected in April 2008 - I'd prefer not to say on the public forum which firm it is, but it is a firm that is listed on here as one of the main ones. Thanks again.

That may help to explain the delay WIKIKEE.

Cases signed from April 2008 onwards can be closed more readily than those prior to that.

If, at this very late stage, they decide to mount PPI claims I don't think that they're in a position to discharge you.

Only one of the debts was a loan and there is no ppi on it, would it help if I contact them again and offer them a copy of the original loan papers?

I think if you can help them to establish that there is no PPI to chase it may help to get things done sooner.

People did have PPI on other types of credit agreements though, it wasn't just loans.

Well i think i might be nearly there. Have received a letter today advising that they have now received the final claims from creditors and will be paying them shortly. Apparently they didn't submit their claims before I was discharged a year ago. I was apparently discharged a year ago but the AIB register won't be updated until the Trustees have been discharged. I can't help thinking that this has happened in the 2 weeks since I wrote to them and told them if I didn't hear back from them with a satisfactory response within 2 weeks I wanted it treated as an official complaint - and they've actually done diddly squat re my case for the past year. The letter also enclosed a cheque for an overpayment of contributions that I queried so that's a small result. It didn't mention anything about PPI claims though so that implies they know that there is no point in pursuing them. Fingers crossed, nearly done!

The part about the AIB not updating the records until the trustee has been discharged is garbage.

I've check some of our cases and the date of discharge are all shown.

Thanks Mark I had been thinking the same thing but what would I know. I will reply letting them know that I know of other cases, whereby this is not the case. Do you think I haven't been discharged then? They say I have.

I've sent form 5's over several weeks and they show on the register.

I've no idea why yours doesn't show, but would certainly ask.

Hi there, sorry to but in on the conversation but I got discharged on 4/10/11. Looking on the AIB website & speaking to them on the phone, they still don't have me discharged. They told me its because my trustee remains in office. Could you just confirm if this is correct or do I have another fight on my hands. Thanks

A question for our experts...

Is it possible that some people are being formally discharged (Form 5 issued) but that the trustee isn't making the AIB aware of this until they dsicharge themselves?

Is part of the process to tell the AIB that you have discharged your client Mark?

Is it possible that other firms might not do this immediately?
