Ok I know you must be tired of Ppi questions but I have a small 1 #128516;. I was discharged on the 3/10/12 last week I received a letter from bank of Scotland saying I was due £1100 to which they would send it to my trustee, ( ag taggart ) now to be fair I have had no problems with taggarts, everything I think went smoothly during my trust deed but when I phoned yesterday to ask about this cheque getting paid to them I got basically shut down from who I think was the receptionist. No way in talking to her she basically said it comes to us and that's it lol, so here's the question. How do I find out if my trustee is discharged? I went on ( accountant in bankruptcy) I put my name in the search to find nothing at all, what does that mean? Also the trustee said they will pay out the claim to my past lenders, now if that's the case can I ask for proof of this being done so I know the trustee is not keeping it? Ps I would just like to add that you's do a fantastic job in here dealing with every1's questions (well done) #128077;
Hi dazza.
If you're not on the Register of Insolvencies it means your trustee must have discharged themselves more than a year ago. You might want to search using different bits of information (postcode etc) to be sure.
If the trustee is discharged they'll not be able to retain the cash and pass it to your former creditors unless the court allows them to reopen your trust deed.
I suspect (but don't know) that there's only one or two firms trying to do this at the moment - so you may well find this isn't applicable to you.
Maybe put your concerns in writing to your former trustee so that someone more senior has to look at it and get back to you?
Thanks very much for the reply, i tried putting as much info in as possible but nothing, to which I thought I was doing something wrong because it wasn't finding me lol, ok I'm going to play the stupid guy, I'm going to phone my trustee and ask why I can't see myself on the register hoping they say that's because the are discharged then I will say ok well if that's the case there's a cheque coming ur way which doesn't belong to you as you are discharged please send it to me, I can't see them re opening the case for £1100, I think the trustee's are trying there luck with this 1 and making a small fortune, If it was definately getting equally shared between my lenders I wouldn't have a problem as at the end of the day fairs fair but I don't think for 1 minute this is this case,
So I called ag taggart today and spoke to tony, I asked him that if I was dis charged and if the trustee was discharged to which he says why do I need to know that? I said because I can't find myself on accountant of bankruptcy to which he replied that they were discharged I said a cheque has been sent to you's for Ppi and if your discharged u will need to re open the case through court to give money to lenders, to which his reply was eh eh mm mm and your point is?? I said my point is are you going to do this? He said eh well mmm yeah we will.. I DO NOT BELIEVE THEM FOR A MINUTE, he sounded as if he had no answers for my questions. I told him I wanted kept up to date on everything that's happening, his reply was aw it could be months, I knew it from the start they are at it RAGE OVER #128516;
I wouldn't assume anything untoward is going on.
Insolvency practitioners are subject to a lot of scrutiny over money coming in and out.
The IP is personally responsible so I'd suggest putting your queries and concerns to him/her in writing.
Just to let you's know that they re opened the case gave the lenders very little and took £550 to themselves for re opening the case
Thanks for the update Dazza. I am aware of Taggarts having been to court and reappointed in another Trust Deed case too.
Did you defend the action in court? I'm guessing maybe not given the likely expense of doing so as opposed to the amount of the PPI?
No I never but I asked for details of everything that was happening so I knew the lenders got there share, they have produced those documents, so I assume they did follow through with it
