Not been told anything from td but have asked on numerous occasions what happens if I get it ,been told though through this site/and others not sure if correct
1:takes 3 years from form 5 to get credit /file back on good side not sure about windfalls?
2:also told not until trustee is discharged are you in the clear again any windfalls subject to trust deed so could take 1-2 years more??
3:Elvis is alive and on this forum
seriously would like answers to 1-2 hee hee
thanks
so once that very elusive form 5 is issued /discharged
sent to me I,m free ?
Hi Maverick
My understanding in relation to your questions:
Your Trust Deed should 'fall off' your credit reference file 6 years after the Default date of the Trust Deed. The default date is the important one.
If the creditor files are matched with the same or a date close to the Trust Deed date, they will also fall off around the same time.
Once your Form 5 is issued you are 'free'.
The rest of the credit reference file depends on how you are, and have been, managing account payments separately to the defaulted account and Trust Deed.
With regard to PPI claims, I believe they go to your Trustee until he/she is also discharged. There is a case on here where a trustee is trying to reclaim a PPI payment after both client and trustee are discharged although this I understand is extremely unusual situation.
You can register with Noddle for free and check your dates and credit reference status for all your accounts registered. Noddle is linked to CallCredit company one of the credit reference agencies. All late payments and missed payments are listed so can affect your rating.
Hope that helps.
ok got email from creditfix they say once form 5 issued i,m still in trust deed till trustee is discharged(poss a few years yet) ref any windfall will go to them till they are discharged so no change then was worried as this is taking so long that when I retire they will ask for my works pension that's why I was asking about windfalls as my works pension would give me 25% tax free when I retire. So i still cannot rebuild my credit or get new mortgage sorted out for some years yet
Hi maverick267.
I think you should submit your understanding of what you've been told in writing to them, and ask them to confirm to you in writing that this is the case.
I suspect you'll get a different answer and that your concerns are unfounded (once your discharge is official).
told until trustee is discharged I,m still in td so any redundancy windfall will go to them. timescale from form 5 which I still have not got yet it will be 6-8 months plus 8-10 weeks to finalize everything.
so you can see the dilemma I'm in not free of td even with form 5 hope not to get made redundant with another company buying us out an hopefully finished before I retire
