Voluntary surrender of home when in TD

Hi,
I signed my trust deed 2 months ago, and am due to begin payments, however my ex partner has now been made redundant. He says that he is not in the position to pay any maintenance towards our son. Im in the position that I pay either the trust deed or the mortgage. And I cannot go bankrupt and keep my job. Am I able to voluntarily surrender my home and have any debt that come as a result of this put into my trust deed?

Hi Papillon, I entered into a TD with the fact my husband fell ill last year. We were paying half mortgage payments but the Northern Rock would not extend them beyond 6mths so I had no other option than to VS my property. We are now living in rented accommodation and have been since June. My proptery sold just weeks ago and we have a mega shortfall which will now be included into my trust deed. My husband is bankrupt and likewise his share will fall into his bankruptcy. Hope this helps you.

As LMM says, it may be possible to do as you say, but first things first papillon. Speak to your trustee and make them aware of the situation. They may be willing to suspend your payments while you consider your options, or possibly until your ex finds work again.

Is it possible that the situation could be mitigated - for example, you may be entitled to more tax credits or switch to an interest only mortgage temporarily etc?

Hello papillon and welcome to the forum.

If you surrender the home I presume that you will have new housing costs (perhaps rent) elsewhere?

Will your housing costs reduce sufficiently enough to enable you to meet all of your essential expenditure and carry on making the trust deed payments?
