Hi,
I signed my trust deed in August 2010 and it became protected in October. I was allowed to keep my home (and am due to pay the ?ú500 to save the equity).
However, my ex partner has advised me that he doesn't intent to keep up maintanence payments. I don't have the money to pay my mortgage on the 1st, and thereafter.
Can I voluntarily surrender my home and move into a rental, and have any shortfall included in my trust deed?
Thanks in advance.

Hi frusciante
The answer is yes. Don't want to get too techy for a Saturday, but any shortfall when repossessed will be a contingent debt and will be a claim in the Trust Deed.
Hope this helps
