Voluntary Surrender Court Citation

Hello,

I entered into a protected Tust Deed back in October 2009.

Long Story short... I have Voluntary Surrendered my home to the Halifax from October 2010 (they also have keys) I secured rented accomodation prior to handing keys in and have no interest in keeoing proeprty.

My Trustee advised any shortfall would be inc with my trust deed.

However, I have rcd a citation from the local court asking me to appear on August the 11 2011. Do I need to attend? Surely if i am not disputing the decree this should be given without any court orders? Afterall I am not living in the property and they have the keys. I have written letter to the court and Lawyers advising this (Yet to send ans wanted advice)

So any advice would be greatly appreciated?Do I need to go to court?

Don't worry, you only attend if you wish to defend the action.

The court have to go through this process.
