Unhappy with IP service

Can anyone give me advice as I'm not too happy with my IP. My details were added in the Gazette on the first week in January and since then I havent had a call or email to advise that my deed is now protected so i assume it is.

I also keep getting phone calls from companies to my place of work and I have to explain the situation every time while everyone is busy around me which isnt ideal.

I have stressed this to the IP who said they would fax over the details to Impact Collections who keep calling me at work, they said they never had correspondence from my IP and thats why they are chasing me, well they called again today and yet again I cant get in touch with my case Manager who either never answers my calls and very rarely replies to emails.

Personally as I cant seem to speak to my case Manager, I think the level of service is pretty poor with very little feedback regarding my creditors and also not replying to voicemails and emails which to me are important as the likes of the bank, credit cards and catalogues ARE STILL ADDING on interest and non payment fees and I even got a default notice the other day, all of which were received in the post AFTER my TD protected notice (5wks after published in the Gazette)

Does anyone else have problems like this?
I'm wondering if other creditors havent received notification of my trust deed and thats why they are still chasing me? Most still are and i signed the deed before Christmas.

One of the creditors is the council for an unexpected council tax bill of ยฃ260 and im worried that they will arrest my wages for the amount if my IP arent doing what they should be doing and thats to speak to these people or send them letters telling them of my situation.

Poor service? Not sure but i'm in limbo to be honest

I'd be pretty sure that you are now in a protected trust deed if you haven't been told otherwise. You may wish to confirm this when you next speak with your contact.

Your insolvency practitioner can help by calling and faxing your creditors and asking them to stop making contact, and it's fair enough that you've asked them to do it. Ultimately though if this creditor ignores their requests there is little your IP can do.

I'd suggest that you use the complaints process at Impact Collections if they have been notified about your trust deed but are continuing to contact you. You should also consider using the complaints process at the original lender as they are in some ways responsible for this behaviour as well and may be able to stop it quickly.

Don't worry about interest or charges appearing on your statements. It's a fantasy because creditors haven't updated their records about your trust deed. They can put what they want on your statements, but it doesn't mean that they're owed it.

You can also request that any creditor backdates a default notice to the start of your trust deed. This can be done now or at the end of your protected trust deed. This isn't work that would normally fall within the remit of your trust deed firm.

If your trust deed is protected, so are you. Please don't worry too much. Lots of people have written here in the past that things can seem a little chaotic at the start while creditors get their records in order. It will settle down in time though.

In the interim you are certainly entitled to expect a reply to any queries or questions you raise with your trust deed firm. That's a minimum level of service really.

I'm sorry to hear that your firm are failing to communicate properly. It would only take a minute for someone at your IP's office to discuss things with you and hopefully put your mind at rest.

If you receive calls you should immediately contact your IP as it is their job to deal with these. We have a dedicated team who chase claims and deal with annoying creditors from day one. They can be a pain though (creditors, not my girls!!)

Interest is legally frozen, despite subsequent mail you may receive and it sometimes is a matter of time until they correct this and submit their claim. So don't worry on that front. The same applies with Council Tax, although they can move quicker than most creditors, so maybe best to pester your IP firm to look into this. I'm sure it will be nothing to worry about though.

Please pester them until they respond and let us know how you get on.
