Well , the letter has arrived telling me to sell my house or face eviction , really felt like visiting them in person to deliver my reply , but I would have got a jail term for that .
Trustee is under investigation by his regulatory body and the Ombudsman , as well as his firms own legal team .

Given that these investigations are on going , is he not trying to scare me and force the issues raised before any official report into my situation is given ?? .

It boils down to saying , the transfer of half of the property was a alienation , so we are going to reverse this , however he has never proven this , even after 5 years of threats , and invitations by myself to go to court .

It is my understanding that for even one minute after the transfer , that I was still solvent the action will fail. I am very confident I can prove my solvency at that point .

Obviously worried about losing my home of 47 years , how best to reply to them before any investigations have been completed ?? .

Hi pinalta.

Hopefully our experts will share their views with you on this soon.

Have you been able to take your own legal advice on the matter? I recognise that this wouldn't be cheap and might not be affordable but the stakes are obviously being raised. If you can find a way to do this I think that everyone here would suggest that you do so as soon as you can.

I'd agree with Trust Deed Assistant. If this looks likely to end up in litigation then you should really be seeking legal advice from a solicitor, pinalta.

Going to seek legal advice on Monday , found a firm called MBM Commercial in Edinburgh , at least you see any fee's up front ,and you know what you are paying for depending on who needs to fight your case . Looks daunting at first , but time to stand up and be counted . I am sure the outcome may yet make Trust deed history ,Edinburgh University offers a free legal advice clinic on a appointment only basis . Also checked my house insurance policy and have had free legal advice , as this is part of my package . As a ancestor of mine said , tell my family I died facing the enemy . The situation may seem hopeless for sum forum members , but never give up , if it was not for the support I have had via this site , I would have handed over the keys , years ago . Sometimes being a pain in the butt to your Trustee and standing up for yourself pays divident's , even though it may only be self respect and pride . Fetch my horse I ride to Valhala !! .

Good look with this today pinalta - at this stage I think it's definitely the most appropriate thing to do.
