Trust Deeds - what happens if someone dies?

I have a friend who is terminally ill and I am trying to help the family deal with the paperwork. She has a trust deed and we have made the trustees aware of the situation (and she has signed that myself and her partner can speak to them on her behalf). Sadly I don't think she will be with us much longer and the person I spoke to could not confirm if the trust deed would die with her or would pass to her next of kin (she has 2 adult children).

They are to get back to me with their understanding of what will happen but I would like to get some independant advice so that we know what we may be dealing with after her death.

Any advice would be greatly appreciated.

Hi Jane

I am surprised that anyone would advise that the Trust Deed could pass to their next of kin.

The matter could be fairly straightforward or possibly be slightly complicated. Firstly, if she has no assets (estate) then the Trust Deed would finish on her death and the Trustee should advise creditors of this.

However if their are assets, house, policies etc, then these could remain in the Trustee's control after her death.

If you could clarify the asset position, I would be delighted to assist further.
