Hi, I have received good advice on here in the past. Here is my situation - my last payment is due on 1 April 2013 and I can't wait! However, I received a pay rise in February and emailed a copy of the correspondence to my Trustee and asked what I should do. I heard nothing, I then called and the insolvency practictioner said she was too busy to deal with it. I have had some real problems with her in the past, not what she is saying but her whole attitude to me which can be at times really rude. I am worried that I won't be discharged and she will want to do another review after my payments are finished. My last review was October 2012. Should I call them again or just wait to hear from them?

Hi carol3110.

Given that you're so close to the end hopefully there will be no problem.

One way that you might cover yourself might be to "put away" some or all of the pay increase in case it's determined that some or all of it should have been paid over to the trust deed.

That way if an increase was due there should be a minimal hold-up in making progress towards your discharge.

It's always a real shame to hear that someone is being treated in this way when they're doing their best to do the right thing.

Thank you - that is what I thought but do you mean the increase I have received. For example I have only been in receipt of it for one month so I can put that away. I am hoping that it is not the annual increase of ยฃ2,500 but I can't think why that would be the case as it is only effective from 1 February 2013.

It should only be for the months that you actually receive it carol3110.

Hi carol3110,

Well done on the payrise. Any extra money will obviously help in the difficult times.

Any increase in payment to your Trust Deed could only be for the period which you received an increase in pay therefore your Trustee could review your situation and decide that you could have paid an increased payment for Feb, March and April.

Try giving them a call again to clarify the matter.

The end is in sight!

From what you say it seems very unlikely that the Trustee will seek an increase for pervious periods. You have maintained your contribution throughout and is not cost effective for them to spend time reviewing and amending contributions, giving instructions to the bank etc for 3 final contributions.

I hope you get some clarification from them soon however.

Hi - thank you all for your help. This Forum has been invaluable to me over the past couple of years. I have now completed my trust deed and received a letter from the Trustee saying that it is finished. However, is there a formal form - I have heard about a Form 5? that I should have received? I would like to use this to write to my creditors as some of them are still marking payments as missed on Experian.

Hi Carol - and congratulations on reaching the end of your trust deed. You should get a Form 5 too - it would normally be headed up "Form 5 Letter of Discharge of Debtor" if my memory is correct.

I guess it may take a few weeks from making your last payment.
