Trust deed while renting privately.

Hi,

I am considering taking out a trust deed but I am worried my landlord could or would evict us if I did?
Has anyone had any experience with this?
I love my current home and donโ€™t want to lose it!

Welcome to the trust deed forum Lawson21.

We haven't heard of this happening to any private tenant in the (many) years that this forum has operated.

Landlords appreciate tenants who have proven to be reliable and, in many ways, entering a trust deed that relieves financial pressure and prioritises the repayment of rent is a good thing for them as well as you.

Having said this, I guess there might be a clause related to insolvency proceedings in your tenancy agreement. It might be worth taking a look at it to see if there are any potential issues (in theory at least).

It's very unlikely there would be any problem, even if the landlord may technically have the right to terminate the tenancy according to its terms. For one thing, there is no reason why the landlord would ever know about your Trust Deed anyway - whilst they could find the information on the Register of Insolvencies they would need to be looking for it.

Unless they are a creditor, which might be different - do you have any rent arrears?

It could be an issue if you are looking to move into a new Private Tenancy as a lot of Letting Agencies will now carry out Credit Checks on perspective tenants. But if you are already the tenant I can't image any letting agencies carrying out credit checks on sitting tenants...
