Hi
Please help. I have been dealing with a company now for over 3 months and my TD is still not set up.
I understand that there are many, many people to deal with in setting this up, and also, their company was taken over by a larger firm so their internal structure is under pressure, however, surely not my concern.
In the meantime, one of my creditors has now taken me to court and the judge agreeed a time to pay agreement. My advisor keeps telling me that this will not matter once the TD is set up, however, my understanding, although very limited, is that until I am protected creditors can proceed with whatever action they feel necessary.
I really don't know where I stand.
I called again today and finally got to speak to my advisor after three days and they are still trying to get it sorted.
Should I just contact another company and start again, or is this timescale the norm. To date I have only paid the fee to have my house surveyed.
Please, please help me as my nerves are now really getting the better of me.
Many thanks
Maria
Hi Maria
Mmmmmmm!! sounds a bit strange. I am not sure about about the many, many people involved.
The process should involve
Day 1 A meeting to look at options.
Day 2-7 Full report of matters confirmed in writing
Day 8 Signing date agreed.
The quickest case I have ever dealt with was turned around in 12 hours. Held the meeting at 9.30am. emailed my Report at 1.30pm and agreed the signing meeting for 7pm that night. The average however is 2-3 weeks maximum.
Hopefully this helps
Mark

Hi Mark and TDA
Many thanks for getting back to me.
I've not actually signed the agreement as yet. I paid last month money to have the survey done on the house.
My advisor keeps telling me that it's near to completion and that the next step is for him to come out and complete the paperwork. Two weeks ago, he hoped to come out today, he is now saying he is hoping for it in another 2 weeks and that he is presurring the IP to deal with my case.
He says that it has some difficulties. I originally had to consider this as I owe Inland Revenue, I am self employed and that they are own about 42% of the debit.
I feel I am extremeley patient and if the process does take this long then I will accept this, but my gut tells me that this is unduly long ?
If you could suggest a way forward. Should I consider meeting up with another company ?
Many thanks, Maria
Hi Maria.
This does seem like a pretty long delay even if there are complexities.
Even if you sign the trust deed there are then other processes to be followed which could also be subject to delays if the business concerned is under a little pressure right now.
In the circumstances I cannot see any harm in speaking to another firm.
Hi TDA
Many thanks. I take it's best to have a look at the companies listed - dreading it, as it's such a minefield ๐
I think I will email him tonight and explain that if I don't have some activity I will move to another company.

Hi mtm0066.
The site feels postive about the trust deed firms represented here by Mark, Shona and Kevin. There are plenty of other good firms as well and I don't think that it has to be a minefield if you choose to weigh up an alternative. You only become committed once you actually sign a trust deed, so there should be plenty of opportunity to ask questions and reassure yourself that you are making a good choice whichever firm you eventually go with.
Hi Amy (didn't realise I could click through to your name)
Many thanks. I'll have a look tonight.

No problem Maria.
Just so you know, the "TDA" works long hours seven days a week so the rest of the advice team help me out by taking over the role sometimes. That's why I (and sometimes we) post as the TDA rather than using my own name. There's a bit more about that on my profile page.
Let us know if you have any more questions after you've had a read and a think.
Hi mtm0066
Thanks for the additional info. I still dont see the reason for the delay to be honest. I think the Revenue thing is a bit of a red herring.
I dont the person you saw or the IP involved were/are in the process of contacting the Inland Revenue before you signed the paperwork.
I appreciate the delay must be a concern, but I'm sure Amy will keep you right.
