trust deed relinquish interest in property

Hi,

I am 1 1/3 years into my trust deed and i have received a letter from my trustee. I tried for a trust deed and was declined and was declared bankrupt but my home was still signed over to a trustee at begbies traynor.

i was told by the trustee's assistant i had to pay ?ú500 to relinquish interest and prevent them having the option to protect if the house price went up it, I wouldnÔÇÖt have to pay any more but now i have received a letter asking for over ?ú16,000. i had called them on numerous occasion to ask what the fee was to be paid and i was told ?ú500 on at least 3 different occasions, IÔÇÖm now worried sick that i canÔÇÖt pay this and when i called they said should speak to citizens advise to sell my house to the council and they will rent it to me??? Surely this canÔÇÖt be right.

my valuation of house ?ú90,000 mortgage ?ú73,000 but house the same as mines 2 houses down is selling for fixed price ?ú80,000.

Any help would be more than welcomed.

i paid this last year around july time and was going to pay the remaining ?ú200 within the next 6 months.

Hi there,

So they thought there was no equity at the time that you signed the Trust Deed?

And now they think the value has increased by over ?ú16000?

In 16 months?

What valuations have they instructed since you started dealing with them?

i was never told what the valuation was but i was really concerned at the time but when i called after the valuation was done i asked what i had to pay and the trsustees assistant told me i had to pay ?ú500 and i asked her if she was sure and she said is what i had to pay.

when i recieved the letter in march they were asking for ?ú16,000 and i called to say whats going on and i was told to ignore the letter, i was just being copied in a response to one of my debtors and again asked if this was regarding my payment and was told yet again no you've paid ?ú300 just pay the ?ú200 left and you are fine.

so when i got the reminder today i called and they that is halifax sending the valuation now, a year and 1/2 later. im totally panicking as nobody can give me ?ú16,000 and im going to have to sell the house with no chance of getting ?ú90,000 when the house down from me is going for ?ú80,000 fixed price.

i dont know leaglly where i stand as i am being told one thing and then the another completeley different thing again.

Hi

I think you need to look at anything received in writing concerning the ?ú500. This at least will give you the basis of a defence to this.

Have you ever received anything in writing or receipt for the ?ú300?

No they never sent anything out and i had to call to ask what i was to pay and never recieved any reciepts. im getting that sinking feeling they have totally stiched me up.

i asked why it has taken so long but they blamed the halifax for the delay in receieving a valuation but it was them who sent out people to value the house when i applied for the trust deed which failed and i went bankrupt and signed with them as the trustee.

update.

they sent somebody to value the house, it was the same person who valued the house before and he asked what the valuation was before, my wife advised ?ú90,000 and he seemed suprised, he couldnt say anything as he was working on behalf of Begbie Traynor but he said it would be a fair valuation, so gonna see what happens and if the value is way off going to get my own independant valuation.
