Trust Deed & PPI

Hi

As TDA says, Trustee's have an obligation to realise funds for creditors. However, normally you are advised that PPI is being claimed, and you could argue it at that stage. If anyone is unhappy, then they should contact their Trust Deed firm. I would certainly not mind anyone emailing me if they are concerned and their trust deeed is with my firm , and I will personally check out the situation for them.

still no reply to my email sent over a week ago regarding my discharge. do you think that i should now approach ICAS?

That's really for you to decide andy.

I'd personally probably give them a bit more time.

i spoke to my trustee today and he says that he is aware that cases signed post april 2008 can be discharged by form 5 while he remains in office to deal with any PPI claims. however he isnt willing to do this as it would mean i could cash any refund cheque and keep the money myself.

why do most firms on here say its possible, and mine say it isn't?
no idea when i will get discharged now, thats 4 months and counting.

I'm sorry to hear that.

It's hard to know what to say other than to point out the obvious which is that different trust deed firms do handle some of these things in various ways.

I hope it doesn't all take too long.

thanks for your reply TDA.

I just dont understand why regulations are in place and a trustee can choose to ignore them if they want? it doesn't really inspire confidence in the trust deed system for the general public.

I think it's a case that there are regulations that allow for this type of discharge to happen andy, rather than regulations that require it to. It's a step in the right direction compared to the rules prior to April 2008.

I can however fully sympathise with your frustration that this isn't happening for you.
