When i was getting advice on the trust deed from the advisor he told me at the time it wouldnt affect me as i was only going to be at my parents short term. The trust deed can be flexible was his words so now i have signed up for it and im into my 7th month now ready to move into a new place and have been told by my new advisor it may not be possible to get the payments changed.I feel extremly let down by this company and would like some advice on a way forward for me.Many thanks

Hi Chopper and welcome,

We had a question earlier regarding a similar matter. Although creditors are given a proposed dividend at the beginning of the Trust Deed, it is only proposed. The Trustee does have an obligation to do the best he/she can for creditors, and some Trustee's may regard this as a deliberate change of circumstances. However, if you told the advisor that your current situation was only temporary, then they should have a note of that in their records. A Trust Deed can be as flexible as your Trustee allows, within reason!!

Hi again chopper.

Can I ask whether the first adviser that you spoke with works for the same company as your Trustee or were you then referred to them?

I currently pay 200 per calendar month,but recently had a wage rise they upped my payments at last review bye another 200 ive told them i cant afford the new ammount due to my new circumstances they have allowed me the last last 2 months to pay old ammount on default tho, when they sent me the new ammount by letter to sign and send back to which i contacted them to explain i couldnt afford that and never agreed to new ammount. But on that payment there they took the 400 out my account although my direct debit is set up for 200 can they do this without my consent?.
