Hi
I'm looking for advice as trying to help my family regarding a Trust Deed where the family member died 3 months short of completing the Trust Deed. This is a complex story where the amount owed to the trustee has more than doubled in the past year and we are at a loss as to how to resolve this. Despite asking for a breakdown of figures and the trustee declining we have been unable to move forward.
I would appreciate any help with this. We have instructed a solicitor who have been trying their best to help but again, things have not been resolved and we are going round in circles.
Hi Moira,
I am really sorry to hear of the circumstances surrounding your post to this forum. I hope that we can try to help a little.
Did your relative own any heritable property? Did they have an up to date life insurance policy? The answer to these questions may have a big bearing on how things will conclude.
Has the deceased relatives estate been dealt with by an executor? We need to understand whether the trustee is going to have an interest in any asset as a result of the death of your relative. This may be why they are not communicating with you. They may be waiting to find out what they are required to do on behalf of the creditors.
If you could provide some further information then we can advise further.
