Trust Deed Monthly Payments - Flexibility?

Hi again

Can I just check something that I may/may not have picked up correctly? Is it true that payments made to your Trust Deed are left to accumulate and a lump sum payment is made to your creditors at the end of three years or are there interim payments made to them? If there are interim payments made to them are these at specific times? I am self-employed like a few other members on here and some months are better paying than others, so it would be good to know if there is flexibility (obviously I would need to discuss this with my provider).

There seems to be conflicting advice about this subject at times...

I'm pretty sure the money gets paid at the end. This allows the trustee to alter theit fee's if required. Although these are set and accepted the beginning, if things change then the trustee may have additional fees

Hi smoothoperator.

Funds would usually be distributed at the end. As much of the work involved in a trust deed is at the start of the process it's common that many of the earlier payments to a trust deed will be covering fees rather than a creditor dividend.

I think that your question is slightly different though and that you're wondering whether it would be OK for your payments to vary during your trust deed?

That's going to be a matter to discuss with your Trustee. Like everyone else they understand that income for self-employed people is often more variable than it would be for the employed. However the ideal outcome would be to set a monthly payment that allows you to set aside a little money in good months to cover months where you do not earn as much.

Obviously in the event of a dreadful month where you simply cannot pay your trust deed it will be impossible to pay over money that you do not have. Where communication with the Trustee is good this could normally be worked around by extending the trust deed in lieu of a missed payment.

Hi smoothoperator

Funds are usually paid out at the end of the Trust Deed. Occassionally, some firms pay dividends before that, but usually only if there are lots of funds in the case, i.e the sale of a house or something similar.

As TDA says, that is a different issue from adjusting your monthly payments, and only your Trustee can comment on that.
