trust deed, joint bank account

good evening.

i entered a trust deed a while back and will be clear this october [:D]
so my trust deed company tell me.

One of my creditors is RBS & when i got married, myself and the wife set up a joint bank account with them, which we have kept open with ?รบ10..

Now my question is if i was to put ?รบ600 per month into that joint bank account so my wife can also have access to it for our weekly shopping trips to tesco etc. Can RBS take any money out of it without informing us ... My wife is not in the trust deed, its just myself who entered it.

With RBS being one of your creditors, I'd say that would be risky. Whatever they're supposed to do or not do doesn't always seem to come into it.

If it was me, it's not a risk I'd be prepared to take with so much money.

RBS have no authority to take these funds or offset them against a pre Trust Deed debt.

Banks can always close the account per their T & C, but not keep the funds.

Hi upnorth76.

Banks are in the habit of using their "offset" rights. As Mark says, they have no authority to do this in your case. However that doesn't mean necessarily that they will not.

You would get your money back if it happened, but the intervening period could be very inconvenient for you.
