Hi All,
I completed my trust deed payments in February of this year and It's been a great weight off my shoulders. I've now got myself a credit building credit card and things are moving in the right direction.
One thing that concerns me is that I've never heard a peep from my Trustee (Carrington Dean) since I stopped making payments.
I've had no letters confirming my obligations are over etc. When I search the AIB, I can't find any record of me or my trust deed. I've only lived at two addresses during the whole process and I've checked the spelling on everything.
Is there anything I should be concerned about? What should be my next steps? Should my defaulted debts change to closed or settled once the trust deed is over?
Sorry for all the questions but I don't want anymore setbacks now I've got my life obn track again.
Regards,
Robbie
My TD doesn't appear on any of my credit files.
I've checked Experian, Equifax and Noodle
Hi robbiegwa.
I'm just guessing but if you've heard nothing from your trustee, there's nothing on your credit file, and you can't find anything on the register of insolvencies, then maybe there's an address error here somewhere.
I'd suggest calling your trustee to see if that might be the issue.
There again... you might be happy enough without it showing on your credit file.
Congratulations on completing your Trust Deed.
It seems strange that the Trust Deed is not showing on your credit files.
Are all your creditors showing defaulted accounts?
With regard to the AIB register, have you tried doing a wider search with less information? Even your name, or name and town, or name and Trustee?
Why don't you give your Trustee a call to ask where your Form 5 is. That is the form to confirm you have discharged all your responsibilities with regard to the Trust Deed.
You would use that form to ensure that your creditors had recorded the date of signing of the Trust Deed as the default date.
Hope you get it sorted out soon.
Hi robbiegwa,
Well done on successfully completing your Trust Deed.
Have you received a Form 5 Certificate of Discharge from your Trustee? This is your official discharge and confirmation that you are debt free. If you haven't received this then I would chase this up.

Thanks for the advice everyone.
I've been calling my Trustee (Carrington Dean) non stop and the number rings out every time so I've now sent them an email with regards to my form 5 etc.
I've eventually found my entry on the AIB register and my Debtor Discharge Date is showing as 26/05/2016. Does this mean that my form 5 has been issued to me and that I've just not received it in the post?
Regards,
Robbie
Hi robbiegwa,
Yes if there is a Debtor Discharge Date on the Register of Insolvencies then this means you have been discharged from your Trust Deed.
I would still chase up Carrington Dean for your Form 5 as this is something you could require in the future. Always good to have this handy just in case.
Good luck for the future and enjoy being debt free!

Thanks for the advice everyone.
I've eventually got through to carrington dean and they sent the Form 5 to the original address on the TD and not my updated current address.
Now that I have been discharged and I have my Form5 what are my next steps? The two defaults on the TD are still showing as defaulted and the dates are after the signed trust deed. How would I go about getting these corrected?
Should the status of these defaults be different now?
Thanks again for the invaluable insight and help you guys provide.
Robbie
Hi Robbiegwa
The dates of the default should be the same as the signing of the Trust Deed. If they happen to be just a few weeks after, sometimes it is not worth all the effort to get them changed.
However, if you wish them to be correct, use your Form 5 (when you get a copy to your new address), contact the lenders and ask that they update your default date to match the Trust Deed signing date - in accordance with the Data Protection Act.
You should be able to do that through the Data Controller, however, I had no success with any of my creditors through that route.
It was generally the 'defaulted accounts' department. The customer services department should be able to give you the number or put you through.
You are likely to have to send a letter, with a copy of the Form5,with signing date circled or highlighted, ask them to update it to the correct date in accordance with the Data Protection Act.
Keep a note of the date, time and name of the person you spoke with, and what he/she said. You may have to refer to this later.
Generally, they say it will take 6-8 weeks to update it. They notify the Credit Reference Agencies monthly, and then the Credit Reference Agencies update the records visible to us monthly, so it can be several weeks before you see it change.
All defaults and Trust Deed should disappear from your Credit File 6 years from the default date, so depending on when you signed, you will have six years to have the date corrected.
Good luck.
