Trust Deed Fraud

As above

Someone fraudulently took out a Trust Deed and didn't declare all their earnings. This was in 2010 and it's now finished but I have evidence to them not declaring their earnings or his wife.

I don't think the police are particularly interested.

Some people feel very angry when they discover that things like this have happened Sold down the river.

Yes I've been sold down the river. How do I find out who the creditors are of someone who took out a trust deed?

Is this information in the public domain?

Hi Donny,

You are not able to find out who the creditors are unless you are a creditor yourself and have been included in the Trust Deed.

There is limited public information available. All of this you can find on the register of Insolvencies which is on the Accountant in Bankruptcy website. If the persons details are not on this register then this means their Trust Deed is completely closed.

Why is it you feel you have been sold down the river? Were you owed money?

There used to be a system in sequestration where an application could be made to the Nobile Officium for a seqestration, but I'm not sure if this would be applicable in a trust deed. Worth checking out though.

Yes, I received very little of what I was owed. I've since found out the debtor and his wife failed to declare additional earnings they had for second jobs.

Receiving so little back forced me to fold my small business.

Yes I assume so. It was taken out in 2010 but I think it's expired now.

You may wish to contact the trustee Donny. The details may be on the Register of Insolvencies still (available online).

It might be too late for them to help much, but it's a starting point.

Hi Donny,

I can understand your frustration especially given that it had a massive impact on your business.

Unfortunately if the Trust Deed has been fully discharged then there isn't anything that you can do.

As TDA has advised, you can check the register of insolvencies for information on their Trust Deeds. If you can't find any information then that would suggest that their Trust Deeds are completely closed.
