Hi I had a trust deed which I paid off over the usual term and was closed off in 2010, so I believe must have been started in 2006 or 2007, prior to the previous law change in 2008. However I have now been contacted by a Student Loans company many years later, Is it still the case that my trust deed which included student loans and for which a dividend was paid on closure was fully covered by my trust deed as documented and there is no retrospective change? thanks
Hi it would have been between 1995-1998
I think you're probably right Scot75. The date that your trust deed began seems to be the key factor here.
Things have certainly changed since then.
I'd like to hear what Kevin or David think though, to add a bit of certainty for you.
I had a similar situation. I can't recall what the key dates are but my TD was started in May 2010 and my student loan was around 1998. My student loan wasn't included in the TD so I'm now in the process of paying that off in monthly instalments.
Hi thanks for the reply, I would be very interested in hearing the additional views of views of Kevin/David? many thanks
Hi, sorry for the delayed response.
You are right, Scot75, if your trust deed started prior to 2008 then your student loan would have been included in your trust deed and you should no longer be liable for this debt.
There was also a couple of years after 2008 when some student loans were covered and some not, though I must admit I would need to check as to which type of loan fell into which category.
Thans Kevin
