Trust Deed Discharge

Hi all,

I’m a first time user of this forum so apologies if what I’m about to ask has been covered elsewhere or I’m posting in the wrong place!

I signed up for a Trust Deed in December 2016, this then became protected in January 2017. Fast forward 4yrs & I have now come to the end of my Trust Deed.

From various conversations held already with TD company they have advised that my account at the time of asking was in the closure stage & I could expect to receive my letter of discharge (Form 5??) by the 11th March...no sign of it as yet however!

However I have noticed that the Register of Insolvencies held by the AIB now has a date of 9/3/2021 recorded in the debtor discharge section.

Does anyone know if this means I’ve been formally discharged & I’m therefore free from my obligations that I had to adhere to when my Trust Deed was active?

Welcome to the trust deed forum steve78.

Congratulations, the addition of this date to the Register of Insolvencies confirms that you have been formally discharged from your trust deed!

Hopefully your Form 5 is in the post and you'll receive it soon.

Discharge confirms that you have completed your obligations and that the restrictions that are associated with a trust deed have ended.

One issue we've seen cause a few headaches (always resolved as far as I'm aware though) is when someone tries to sell their home after their discharge, but before their trustee is discharged. If this isn't something that your planning then I think you can fully move on now.

Thank you TDA for confirming that. I must admit when I first saw it yesterday it seemed a bit surreal & almost too good to be true, especially on my birthday of all days!

Do you know if it’s possible to request a copy of my form 5 via email or are they typically sent by post?

I ask as I applied for car finance a few weeks ago at the point where I’m was advised my account was cloising however finance company picked up on what they deemed an IVA on my credit file & as such they either wanted a signed permission form which they provided stating TD company had no objections to finance or some other proof to show my account was closed.

Would it be likely that the information on Insolvency Register would be sufficient to prove my discharge to them or is a Form 5/signed permission form all they’ll accept?

Hi steve78,

There's no harm in asking if they can email you a copy.

I think you'll need to check directly with the vehicle finance provider what their expectations are for proof of discharge. Different firms might have different requirements.
