Hi can someone explain the process of discharge, I made my last payment on the 1st of September last year I have called and asked when to expect discharge twice now and both times I've been given either 6 months then up to a year, I have checked my credit file and it says I will be discharged in aug 2018, and can my debt be sold onto a debt recovery company right after my last payment was made?
Welcome to the forum Diane.
Your credit report doesn't indicate when you'll be discharged. What you're seeing in this respect must relate to something different.
We know that firms can discharge you pretty quickly once you've completed your obligations to a trust deed. In reality however some firms do this much faster than others and there are no set timetables that they have to work to.
Sorry that there isn't a straightforward answer to your question.
Hi Diane
There are two discharges that happen - yours and your trustee's. Yours should happen quite quickly after you have met all of your obligations under the Trust Deed. Your trustee's would normally take a little longer.
Have you checked the Register of Insolvencies to check your entry(you can access it via the Accountant in Bankruptcy's website)? Might be worth doing just to double check you aren't already discharged yourself.
Thank you for your replys, I have looked into the Accountant in Bankruptcy website and put in my info and it came back with no results, does that mean I'm discharged? Also can you tell me that at the end of my td payments and having paid in over £10,000 for £8,000 debts I've been told that I only have £3,000 left after td fees will I now be expected to find another £5,000 to be completely out of this debt. Sorry to ask again but I do need to know if it's right that some of my debt has been passed to debt collectors after my last payment, feeling that I'm no better offf now than I was at the start of this td.

Hi Diane
When you go on to the AiB website, make sure you scroll down to the bit that says Access AiB systems and tools. Then click on the button which says Register of Insolvencies. That's where you need to put in your info to see if you are still on the Register or not.
It sounds as if your trustee really needed to explain things to you better at the start, so don't be afraid to ask them to do that now. That's part of their job.
From what you say, you owed £8,000 at the start of the trust deed. It sounds as if you have paid in £10,000, between your contributions and PPI refunds. After the Trustee's fees have been taken out of that £10,000, it only leaves £3,000 in the pot. You're worried that you'll have to find the other £5,000.
Don't worry [:)]. The £3,000 in the pot will be split among your creditors and then they have to write off the other £5,000. They're not going to get any more, and if they chase you for more you can complain. Don't pay them!
If you're being hassled by debt collectors, tell them that you're in a trust deed and they should contact your trustee. Pass the debt collector letters on to your trustee and tell him to deal with it.
Point out to your trustee that you haven't been discharged from the trust deed. He hasn't been discharged as trustee. Dealing with your creditors and their debt collection agencies is still his responsibility. It's part of the service that he's taken £7,000 for.
Seriously, put all of these questions and concerns and debt collectors back to the trustee. [:)] You shouldn't have to be worrying about them.
Hi Diane,
I'd try to search again, perhaps using fewer details (surname and town only for example).
Your entry stays there for a year after your trustee has been discharged, so if you made your final payment in September 2016 you should definitely still be on there.
Once you find the entry you can see whether a discharge date has been added for you (and for your trustee).
