Trust Deed completed and still debts being chased

Hi Guys,

My TD started in 2006 and I was discharged in 2009.
I have in the last year had EGG transferring an account to Barclays and today had Cabot Financial contact me 3 times saying they purchased a debt (both was included in my TD)in 2010!!??

I was not happy and made that clear over the phone but the guy was not that interested but I made sure he took my trustees details and I will call them myself 2mrw also.

Any advice would be appreciated, its a bit worrying!

Hi Hamish.

I can appreciate your concern, but if these debts were part of your trust deed there is nothing whatsoever they can do to you.

If the calls continue I'd suggest writing to the debt purchasers with the details of your trust deed so that they can confirm the situation with your trustee (or just against the Edinburgh Gazette entry that will still be publicly available for them to check).

If that didn't work I'd then initiate their complaints procedure which I'm sure would bring things to an end.

It's a major shame that your original creditors haven't got systems in place to prevent the sale of debts that do not exist.

Thanks TDA much apprciated, Cabot were desperate to get my current address but I wouldnt give him it, must admit I lost the plot a bit at him think i need a glass of wine to relax a bit.....

I think those that sold the debt can still deal with unlawful chasing of debts included in the trust deed. Rather than chasing lots of people.
