Hi
Looking for some help.
My trust deed finished around may 2015.
It was meant to finish Jan 2015 but was extended 6 months as I had earned extra money.
However nearly two years later I received a call today saying I owe around £5000 and need to produce wage slips from 2014 - 2015 to close trust deed.
There response for no contact in two years was they were trying to get my bank statements.
I have asked for a letter to explain as was pretty annoyed.
Does this seem valid.
Please advise
Thanks

Welcome to the forum Del28.
There's obviously some confusion here and I think you've done the right thing to ask for a letter confirming the current position.
The reality however is that a trust deed isn't completed until your trustee considers that you have completed your obligations and arranges for your discharge to be entered onto the Register of Insolvencies.
I think it's best to wait and see what they put in writing for you at this stage as we could only guess regarding what the current situation is.
I can't see any reason why it should take 2 years for this to be brought up. Quite right to question this.
Have you checked the Register of Insolvencies, Del? Might be worth double-checking that you weren't discharged already.
Hi
To be fair when applying for anything the trust deed was still sitting on my file so not closed.
I just can't believe there had been no contact in two years then expect to start paying more money when my finances are totally different , like more rent and car to pay.
Surely a random letter would have been better than a random phone call yesterday.
Quite frustrating as I was told after 3 years it would be done but then was assured another 6 months and that is it.
Nearly 5 years now and I still seem to owe decent money.
Shocking service to start with I think!!!
Thanks for replys

Hi
Looking for some feedback after receiving letter.
After 3 years of trust deed I was told it was extending 6 months to cover arrears.
So after 42 months I had paid £9,660 against debts of £15,000.
Now 2 years later after no contact they are saying I have arrears of £4,365 to pay.
So basically iv to pay back all my debt with this company receiving 90p in the pound.
Shocking service and feeling duped.
Please advise.
Thanks

Thanks for reply.
They want to see my wage slips from 2014 as I earned extra wages at this time they say which maybe I did but I'll do well to trace it back I think.
I don't understand why after 3 years in the trust deed it's extended by 6 months to complete.
Yet 2 years later it seems within that 6 months i owe another potential £4000+.
Seems extreme and they have mentioned trust deed would be failed if I don't follow steps now.
I would imagine a failed trust deed would mean iv lost the £9500 iv paid in and still owe previous debtors full amount ?
Thanks

Hi Del28,
I can understand your frustrations regarding all of this. It’s a little tricky for us advise you fully because we don’t know exactly what has went on in your Trust Deed.
When you sign a Trust Deed you have an obligation to notify the Trustee of any change in financial circumstances during the period of your Trust Deed which then allows this to be reviewed at this point in time and if necessary then an adjustment in your payment. Saying that I’m not sure why it’s taken from what you say 2 years for this to be brought up and then for you to be asked for a further £4,000+.
How do they know you might have earned extra money back then?
I would correspond with your Trustee in writing to ask exactly why this has now only been brought up and to put across any concerns that you have regarding the handling of your case. Ask for them to respond in writing.
When they advised that your Trust Deed would be failed did they say if they would apply for your Sequestration (Bankruptcy) or simply release you from your Trust Deed without granting your discharge from your debts?

Hi David
Thanks for feedback.
They have got bank statements from that period.
After 3 years of the trust deed I was told another 6 month extension would cover it.
Feels with these sums being branded 2 years later that I was not even close.
They never went into any detail with failed trust deed but I will highlight this in my letter back to them.
Thanks
