trust deed being extended

I received a letter advising that my trust deed is being extended due to an increase in my income.

I'm not happy as I have always paid and send all of my information when requested for my reviews. My review should have happened July 2014 and I have just received this letter today. I have called several times regarding my review and change of income and was advised not to worry.

Basically I am paying a monthly fee for nothing. I am being penalized because my review didn't take place when it should have. I feel so angry. Can anyone help?

Hi Leelee, I believe that your trustee can increase your monthly payment if your circumstances change and you can afford to make a larger contribution. I can't say I've heard of a TD being extended to collect this however. It does seem a little unfair if you have been open with them about everything.

Welcome to the forum leelee.

You must be very frustrated given that you've done the right thing.

If there is any (admittedly very small probably) consolation it might be that the extra money you'll pay over now should be no more than would have been paid earlier if their assessment had happened sooner.

How long has your Trustee advised that your case will be extended?

Its being extended by 6 months. Every time I called I was advised they were in the process of moving office. I don't mind paying the extra money. Its just the fact that my trust deed is being extended. If they did the review when they should have my trust deed would be over in July.

Have you made that point to them and that you feel it is unfair?

Also, what's the reason that you could have increased the payments, was it down to an increase in income?

Yes its due to an increase in income. I did expect in increase in my monthly payments. But would have liked it to have been last year. I will contact them today but I'm not hopeful as I cannot see an alternative. It just seems unfair.

Hello leelee.

It does seem unfair.

It's also a little unfair on your creditors who would have received their payment sooner if this has all been taken care of in a timely fashion.

I'm not sure that your trustee will see this as reason not to collect the money for your creditors now though as that, effectively, would also be pretty unfair on them.

It is a poor show in your Trustee's part. Maybe worth complaining in writing, see if they can be persuaded otherwise?
