Trust deed and wage arrestment

Hi

I am currently in a trust deed however since signing it I have became seriously behind with my council tax. I was in the process of trying to come to some sort of payment arrangement with Scott and Co. and they sent out the income/exp form on the 17th of March. I sent it back on Thursday 24th March and emailed them to let them know. However on Saturday I received the dreaded letter that my wages are to be arrested. Can they do this if I am in a Trust Deed?

Welcome to the forum hilly1986.

Presumably this is a new debt that has built up after your trust deed began?

Has the wage arrestment actually happened, or have you been informed that's what they're going for?

I'm afraid they can, hilly1986, as long as the debt accrued after the Trust Deed was signed.

Do you think the problem is that the Trust Deed was unaffordable for you in the first place?

The trust deed wasn't unaffordable to start with but due to circumstances it is now. They haven't taken money from my pay yet as I was just paid before I received the letter but there has been a letter sent to my employer to say this is the action that has to be taken.
