trust deed and new circumstances

Hello

I am pregnant and called to inform my trust deed of this, I pay £800 a month when i go off on maternity there is no way ill be able to pay this amount, when i contacted them they informed me that they would need proof surely i cant wait until my first maternity pay to show this as i wont be able to make the required payment?

I also find it hard how am supposed to be able to get anything for my baby when am not even allowed to save..... although this was a surprise I feel i cant properly enjoy this pregnancy knowing i still have money worries and maybe made a wrong choice in doing this trust deed

has anyone been in this situation that can advice? id rather pay than extend the trust deed.

Hi lilone.

I think it's understandable that your trustee will require documentary confirmation of your changed circumstances. Because the start date of the maternity leave could be subject to change it might be impossible to plan exactly how this will develop right now.

It might be worth trying to come to some kind of arrangement with your trustee in respect of the essentials you'll need to buy before your baby is born. I can't see what could be lost by trying this and it should be obvious to any reasonable person that some additional expenditure is going to be necessary before (as well as after) the birth.

I do hope someone with personal experience of this scenario might be able to share here how this worked for them.

Isn't there some kind of evidence provided by your doctor/ante-natal clinic of your due date, which you would use to formally notify your employer? Presumably that would suffice as evidence for your trustee too, along with something showing what your maternity pay entitlement will be.

Try not to worry, Trust deeds are meant to have some flexibility to accommodate changes in circumstances. Hopefully your Trustee will be reasonable.

Hi Lilone,

Congratulations, firstly as Kevin has said try not to worry as Trust Deeds are meant to have some flexibility to allow for change in circumstances.
As for evidence you could provide your Trustee with a copy of your Mat 1B Form or a letter from your employer confirming the commencement of your Maternity Leave and pay, this would then enable you to hopefully come to some arrangement regarding possible reduced payments when your surplus income changes.
