Trust deed and divorce

Hi,

If I have a trust deed agreed and protected, does this mean that my finances are in order and there is therefore no reason I can't proceed with divorce?

I'm not sure that I fully understand your question. Perhaps you could explain a little more about the connection between your finances being in order and your going ahead with divorce proceedings?

Being in a protected trust deed is no barrier to divorce in itself.

Are there any jointly owned assets that will need to be dealt with?

Hi, thanks for the reply.

Our house is being repossessed and this is being covered in my trust deed, there are no other assets. My ex partner is not involved in a deed and I was wondering if this would have an effect on divorce proceedings.

I can't really see how Scorpio1.

I suppose obtaining representation might be difficult while your budget is restricted though. This may or may not be an issue for you based upon the circumstances.

Hi Scorpio1

I have dealt with a number of trust deeds in a similar position and it has had no real effect on the divorce process. In fact I've found that the Trust Deed makes the process a bit smoother where there are assets etc involved as it tends to take away any gray area about ownership etc.
