Hi,
Just wondered if I could have some advice as I'm not entirely sure what is happening. I have a trust deed in place with CWF. I was told it was for 4 year, which I believe to be correct. However the issue I have is my statement reports all indicate that it is 4 and a half years... 54 months. I expected to be finished by June 2021, how the report says " discharge 30/01/22 which is 54 months. Any help would be much appreciated.

Welcome to the forum Lesley.

It's really hard for us to comment without knowing what was in the original trust deed agreement that you signed. Do you still have a copy of that? If not you could ask the firm to provide you with a copy.

Hi Lesley and welcome to the forum.

Like TDA has advised itโ€™s a little tricky for us to advise you without knowing what the original proposal was. You can find this out from looking at the original set of paperwork that you signed at the start of if you donโ€™t have this reach out to your Trustee to request a copy.

When you sign a Trust Deed the minimum payment period is 48 months. Sometimes Trust Deeds can run longer than this for a number of reasons. This can be to pay over the value of an asset at the end of the 48 months or for you to pay in enough money that the lenders will accept the proposal.

Also in the update reports that are sent to creditors on these the Trustee needs to provide a date for which they expect the Trust Deed to be completed. It could be the case that your Trustee has given themselves 6 months to facilitate this once you make your final payment in June 2021.

I would reach out to your Trustee and ask them how many remaining payments you have and when you can expect to receive your Form 5 certificate of discharge.

Once you have spoken to your Trustee and received a copy of the paperwork from the start we can help you further.

If it is your copy of the Form 4 - annual report to creditors - that you are looking at, then the date will be when the Trustee expects to get his/her discharge - which would normally be a few months after yours. So probably nothing to worry about. No harm checking though, just to be on the safe side.
