Hello

Im currently 2/3 into my trust deed, which one of the creditors was hmrc, from a house rental idea, i had a few years ago, when i waent thro my trust deed, it was explain that i no longer owned the properties and was also told the hmrc could easily check this. today i have received a self accessment form for year ending april 2011......do this me the hmrc are still chasing me, thought the idea of this was the creditors were not allowed to chase you once you entered a secured trust deed, any ideas???

Hi craig1874

Best pass this to your trustee. It will be fine, sometimes it takes a while ( sometimes a long while) for them to update their records. But you'll be fine as I'm sure it's nothing more than an inconvenience.

As well as passing the details to your Trustee as Mark suggests you may also consider sending a copy of the Trust Deed to your local Tax Office outlining that your SA reference should have been closed due to the Trust Deed and the fact that you no longer have any income relating to a Self Assessment Tax calculations.

Hi craig1874.

The other thing to bear in mind is that anyone can be sent a self-assessment tax form by HMRC.

I know people in PAYE employed positions that have received them.

This may well have nothing to do with your protected trust deed at all.

thanks for your help, have sent letter to hmfc and trustee, awaiting response.
If the hmrc do still want me to fill out the self assessment do i simply put in the details from my p60.
sorry another question, i've never had any updates or progress reports from my trustee, is this normal.

Hi craig1874.

Please don't feel you need to chase up the experts for answers on the forum. We all fit posting on here around our day jobs and family lives, and you'll find not much gets missed if you wait a little while until the next person checks into the forum.

We probably shouldn't give tax advice. Hopefully the forms and guidance notes will be sufficiently self-explanatory, but if not HMRC has advice lines to help guide you.

Have you never been asked for information in connection to a review of your trust deed?

yes had 2 so far, but never had a summary of what ive to pay to the creditors and an approx finish date, just to give me a countdown

Hi craig1874.

You just need to continue making the payments requested by your trust deed firm. They'll be responsible for working out what will go to your creditors.

If nothing has happened requiring a reduction in your payments, a suspension of your payments, or if there are assets still to be dealt with, you can expect your trust deed at the time envisaged at the start of the trust deed.

If you want to confirm any of these details I'd suggest just giving your trust deed firm a quick call.
