My partner has paid his trust deed religiously for 4 years. After his last review where he had to send in a years worth of bank statements, he was advised he had to pay another 18 months at the same amount. He has debts due to gambling and he had a relapse for a couple of months and this seems to be the reason. He has since blocked himself from all gambling websites and apps etc and has not gambled since. It was an addiction and only 1 blip in 4 years is good, he had to borrow money to put back in his account to cover bills etc. One slip up which was for £700 is now costing him an extra £500/month for 18 months. Can they do this? He has always paid them on time for the amount asked, he had a problem that he has dealt with and it seems a bit harsh even though he told them he had a mental health problem they have no compassion

Hi lesleyelizabeth,

It's difficult to comment without knowing the full circumstances, but what you've described doesn't strike me as a reason why a Trustee would extend a Trust Deed.

Extensions are usually seen in cases where a debtor has failed to notify the Trustee of an asset or an increase in affordability. Is it possible that during the term of the Trust Deed your partner has come in to a cash lump sum (possibly winnings from his gambling?) or a payrise that he forgot to notify the Trustee of?

Hi DBHA21

He has not received any lump sum nor has he ever won anything, that's how he got into such a state in the first place lol. He called them when they extended it as was told that as he could afford to gamble he could afford to pay longer! He explained to them it was an addiction and he had since blocked all gambling sites so couldn't gamble even if he wanted to. He also hasn't had a pay rise, he relies a lot on overtime so if anything his earnings went down due to the pandemic. They sent him an email asking if corona was affecting his income and he said yes but there was no reply so he's had to pay nearly £500 a month all the way through

Hi lesleyelizabeth,

I think your partner should request a precise breakdown of exactly how the trustee has arrived at this extra £9,000 (18 months times £500) figure to be paid into his trust deed.

Hi lesleyelizabeth,

As TDA says, given that feedback I would definitely be requesting a breakdown of how they have arrived at that figure.
