Hi there, myself and my husband were discharged from our TDs in May this year. Having heard about the recent PPI stuff in the news I looked through old paperwork, I found that we were misold PPI on quite a lot of loans and CCs that were included in the TD. Now that the TD is completed would we have a case to reclaim PPI? Or would the money claimed just go straight back off the debt?

Hi Quiggles.

There is nothing to stop you trying, though I expect some creditors would choose not to pay you even if you "won".

I really wouldn't use a claims company. The danger is that the claim is "won" so you get a bill to pay, but the lender concerned withholds payment so you're out of pocket.

Even if I could I don't think I would - would feel really cheeky doing it when I have only paid them a small percentage of what I owe them.

I hope my trustee doesn't try to chase mine on my behalf, I was one of those silly individuals who asked for PPI on everything I got. Agree with Scotslad though, I'd feel a bit weird about it seeing as I couldn't pay them everything I owed.

@ Gillian -

The problem has arisen with being being mis-sold PPI, e.g. if you had it added to your loan without your knowledge, or were told it was compulsory or would increase the chances of loan being approved - if you asked for it then you wouldn't have a claim.

I do have some morals. I will not be claiming from anyone involved in the TD. only loans and CCs that were paid up before we started ๐Ÿ™‚

Although, it may be that PPi being loaded onto loans and credit cards could be that extra expense that tipped a lot of prople into insolvency. Particularly when somebody has refinanced loans more than once and the insurance cost becomes part of the new loan and further insurance taken out on top to cover the new loan etc etc It's amazing how much money is involved if you look closely at it.

Anyway, my point I guess is that if there is any soul-searching to be done over PPI claims it shouldn't be on the part of those that were missold it. Claim away I reckon, see what happens. As trust deed assistant says though, best avoid claims companies, there are plenty of templates etc out there to help you do it yourself.

Scotslad,

I'll happily admit to being a div and asking for PPI. Unfortunately I've read that my trustee is one of the ones mentioned on here a while back that wasn't discharging people until they'd tried to recover PPI or bank charges. Although I'll be skipping when the last payment comes off, I'll be apprehensive till my discharge drops through my door and into my grubby little mitts.
