tax rebate

i claimed a tax rebate in sept 15 after numerous phone calls to my trust deed company ,accountant,hmrc i discovered that this money was being held back by hmrc i again phone my trust deed co to explain that this rebate was for fuel expenses incurred by me through the year, the trust co advised me to write a letter explaining all this which i did and after another phone call they told me that they had no problem with this and the money should be paid to me,and waited and waited! assuming that hmrc was still withholding this payment i phoned hmrc yet again today 5,1,16 who told me that the rebate had been paid to the trust co on 7.12.15, i again phoned the trust deed co and told them this and they confirmed that they had in fact received the money! i have never had a phone call,text,email,snail mail from them at any time throughout this saga i feel very badly let down by them, do i have any recourse?

This must all be very frustrating and annoying for you.

When you mention recourse, what would you hope or expect to achieve?

Perhaps he/she would like at the very least an explanation from their trustee?

I'm sure that's the case tinsoldier - I certainly would.

"Recourse" can mean a number of different things to different people though, which is why I was keen to understand a little more about how gavriel is thinking in this respect.

I'm not sure that this is subject to question tinsoldier, gavriel reports above being informed that the money could come to him.

The issues seem to be a delay in receiving the funds and the lack of communication.

It sounds like an admin lapse to me rather than anything more sinister, but no less frustrating and annoying I'm sure.

Hopefully they will sort it out quickly and maybe even apologise for the delay!

Hi Gavriel,

As Kevin has advised I think it could be down to an admin error.

If your Trustee has advised that you can receive the money then I'm sure they will forward this to you.

Give them a call to chase this up and let us know how you get on.

David is not currently posting in the Trust-Deed.co.uk forum

hi all thanks for your answers, after yet another 2 phone calls to the company i still cant get a straight answer from them! i have been told that the insolvancy practitioner is looking into it! for 6 months! this company has NEVER contacted me either by any means of communication i am willing to believe that it could be an admin error but surely after all my phone calls and explanations about this money being a reimbursement of money paid out by me over the preceding year for fuel expenses i worry that my next claim to hmrc will go the same way! remember this has been ongoing for six months now some admin error, the recourse that i am looking for is an acknowledgement and apology about the offhand way and ignoring of my case, i fully understand that they have a duty to my creditors but where in all of this is their duty to me as a client? who faithfully pays them each month, ijust feel so frustrated at heir apparent lack of concern

can i also add that at no time has this company ever explained to me about any assets i may have being sequestrated if that is the right word? i have been and still totaly in the dark over all of this

Hi again gavriel.

I agree that you're entitled to be treated respectfully and efficiently by your trustee. They will be earning a significant fee as a result of you appointing them to handle your case.

You do have the option to submit a formal complaint to your trustee about this, along with a request for an apology. Insolvency practitioners have to take complaints seriously. A complaint would likely result in someone senior reviewing the circumstances that you're concerned about.

Do you have a specific concern in respect of assets?

hi, another phone call today (friday) another fob off! re assets i am due to retire in a years time and am concerned that any lump sum will be dealt with in the same manner as the tax reimbursement? as for complaining to the trustee that may be difficult as i dont even know who they are! having as i said no correspondence from this company no updates,no statements etc, i just feel that i am banging my head on a brick wall,this is a disgraceful way to treat clients!

Hi gavriel.

If you're in telephone contact with the firm you can ask for a copy of their complaints procedure and the appropriate contact details.

I have little doubt that this retirement lump sum will be paid to you rather than to your trustee.

A more important question however is whether your trustee would feel obligated to utilize some or all of any such lump sum received prior to your discharge to help repay your creditors.

I'm interested to hear from Kevin and/or David how this scenario might be viewed by a trustee.

When is your trust deed due to end?

Do you have any flexibility regarding retirement dates and/or the receipt of a connected lump sum?

i have just been informed that i am not getting the rebate putting me at a disadvantage now and any future rebate claims what a farce!
