Hi, I have a trust deed which I am in the second year of 3. I have 2 jobs so one of which I pay 20% at. Today I have had a notice from inland revenue stating I am due a tax rebate but they are paying this to Creditfix who my trust deed is with. Is this correct? I thought as long as I was paying my monthly amounts as agreed that I would receive this as I have been paying too much tax in the first place

You'll need to liaise with your trustee on this - it's their job to determine how these funds should be treated to be fair to all parties to the trust deed. HMRC are sending them the funds so that they can make that decision and proceed accordingly.
Your trustee will need to weigh up whether this rebate effectively covers money that you have been allowed to cover your expenditure, or whether it's additional funds over and above the expenditure allowances that you/they agreed to in the first instance.
If it's the former you may well have some money returned to you. If it's the latter the money is likely to remain in your trust deed for the benefit of your creditors.
You can certainly make a case to your trustee why you feel that some or all of these funds should come to you.

Sending it to the Trustee is a fairly normal process as this absolves HMRC from any issues of who is entitled to the money. Similar to the banks with PPI etc.
Probably best to speak with your Trustee and try and see what their stance is on this and if any of the repayment will be returned to you.

Thank you for your quick response. I am a nurse and it for bank shifts and the rebate for my subscriptions and travel expenses
Regarding the bank shifts, it's likely going to come down to whether this income is already calculated into the "income and expenditure" used to work out your trust deed payment.
Similarly, your trustee will want to review whether allowance has been made already for travel expenses and professional subscriptions.
These are things that only your trustee can provide you with a useful answer about. I suggest that you get in touch with them Linda Mac and make your case to them.
